The USCIS also announced that for all family-sponsored and employment-based preference categories, applicants must use the Dates for Filing chart in the Department of State Visa Bulletin for October 2023. Thus, while most of the family-based and employment-based categories remain retrogressed under the Final Action Dates chart, the announcement of the October 2023 Visa Bulletin should allow many eligible adjustment of status applicants who were unable to concurrently file their adjustment of status applications with their underlying immigrant visa petitions for the last several months to now file for adjustment of status beginning on October 1, 2023 (especially for the EB-2 and EB-3 employment-based categories).
